Religious Legal Systems

A guide to research on religious legal systems through the Dalhousie Libraries

Introduction to Canadian Law and Religion

Canada is a secular state without a state church or religion. Having said that, our laws and institutions have been deeply influenced by Christian teachings and traditions. These have shaped many of our ideas of equity and human rights. When we speak of "Good Samaritan" laws for example we are referencing a story in the Christian Bible.

Legally however, Christianity has no greater status than any other religious or belief system. Canada is increasingly a multicultural and multi-faith community, and all Canadians' freedom to hold (or not hold) religious beliefs are protected in the Canadian Charter of Rights and Freedoms. In a secular society, the freedom to practice one's religious beliefs has limits, and sometimes these freedoms and their limits are tested in the courts.
